The Lakeland Ledger is reporting a massive crash on Interstate 4 that tragically killed on Orlando woman. Apparently, Marva Jean Daniels, of Orlando, was driving her Ford Focus westbound on I-4 through Lakeland passed the West Memorial Boulevard exit.
At the same time, a semi tractor-trailer being driven by Michael Casey Cross was entering the Interstate from the West Memorial on-ramp. Reportedly, Ms. Daniels began to slow her vehicle for some reason, but the semi tractor-trailer was unable to avoid crashing into the Ford’s rear end. As the vehicles came to rest, the Ford burst into flames. Tragically, Ms. Daniels was pronounced dead at the scene.
As a Florida accident attorney, my heart goes out to Ms. Daniels’ family over their loss. Generally, responsibility for rear-end accidents lies with the vehicle in the rear. One of the only exceptions to this general rule is a sudden and unexpected stop. From the reporting, it does not appear that Ms. Daniels’ vehicle was stopped, or that anything she did was sudden. It would be interesting to learn what any eyewitnesses had to say about what happened. If there is no good excuse, it looks like Mr. Cross might be liable for this crash and the damage that has been caused to Ms. Daniel’s family as a result of her wrongful death.
