A truck driver was injured and taken to the hospital last weekend after his semi-tractor truck overturned on Interstate 4 in Winter Park at the infamous Fairbanks Avenue curve.
Frequent readers of this blog will remember that I have blogged several times over the last few years about the curving section of Interstate 4 as it crosses over Fairbanks Avenue. For many years, drivers have complained about losing control of their vehicles on that section of highway, especially during or after rain. This area has been the site of dozens of serious car accidents.
In just the last week or so, the Florida Department of Transportation (FDOT) has been doing work on the Fairbanks curve, cutting grooves into the pavement so supposedly increase safety. At this point, nobody knows whether the grooves have actually made the curve safer, or whether the recent semi truck accident was caused by the grooves.
As an Orlando accident attorney, I know that it is very difficult to hold the State of Florida liable for planning decisions, such as how a road will be laid out, how many lanes will be utilized, etc. However, once a state agency begins operations such as changing the road, the agency must use reasonable care in the way it conducts the work. It will be interesting to learn if the truck accident mentioned above is connecting in any way with the recent grooving work.
