Do You Really Need Medical Payments (MedPay) Coverage in Florida?

Understanding MedPay Coverage in Florida: Is It Necessary?

Driving through the busy intersection of Aloma Avenue and Lakemont Avenue in Winter Park often requires more than just focus; it requires the right insurance protection. While Florida law requires every driver to carry personal injury protection (PIP), many residents still face unexpected medical bills even with “full coverage.”

A common question we hear at our law firm is whether adding Medical Payments (MedPay) coverage to a policy is actually necessary. When you are dealing with the aftermath of a collision on I-4 or a local road, the answer often depends on how much of your own money you are willing to risk.

The Limitations of Florida PIP Coverage

Florida is a no-fault insurance state. Under Florida Statute § 627.736, every motor vehicle owner must carry at least $10,000 in PIP benefits. This coverage is designed to pay for your medical care regardless of who caused the accident.

But PIP has significant gaps that often surprise injured drivers. By law, PIP only pays 80 percent of your reasonable medical expenses, which means you are automatically responsible for the remaining 20 percent out of your own pocket. If your medical bills reach $10,000, you will still have a $2,000 balance that PIP will not cover.

Furthermore, PIP benefits are capped. If you do not receive medical care from a qualifying provider within 14 days of your accident, you may lose your PIP medical benefits entirely. Even if you meet this deadline, if you are not diagnosed with an “emergency medical condition” (EMC), your medical benefits are capped at just $2,500. With an EMC diagnosis, the maximum benefit remains at $10,000, which can be quickly exhausted after an emergency room visit or surgery.

How MedPay Fills the Gaps

MedPay is optional coverage that serves as a safety net for costs PIP leaves behind. Its primary function is to cover that 20 percent gap that PIP does not pay. If you have a $5,000 medical bill, PIP pays $4,000 (80 percent), and MedPay can pay the remaining $1,000.

Unlike PIP, MedPay is strictly for medical costs. It does not cover lost wages or replacement services, but it provides several specific advantages for Winter Park drivers:

  • Covers the PIP Deductible: If your policy has a PIP deductible (which can be up to $1,000), MedPay can often be used to cover that initial cost
  • No Deductibles: MedPay usually has no deductible of its own, providing immediate first-dollar coverage
  • Coverage Beyond the Cap: If your medical bills exceed the $10,000 PIP limit, MedPay continues to pay up to its own policy limit
  • Protection for Passengers: MedPay typically covers you and any passengers in your vehicle, regardless of their relationship to you

MedPay vs. Health Insurance

You might wonder why you need MedPay if you already have health insurance. In Florida, auto insurance is primary. Under Florida statutes, your auto insurance must pay before your health insurance kicks in for car accident injuries.

Health insurance often comes with high deductibles, co-pays, and restricted doctor networks. MedPay generally allows you to seek treatment from any provider without worrying about whether they are “in-network” for your health plan. It provides a seamless way to ensure your providers are paid quickly, which can be vital for maintaining your credit and continuing your recovery.

Is MedPay Worth the Cost?

For most Central Florida drivers, the cost of adding $5,000 or $10,000 in MedPay coverage is relatively small compared to the potential out-of-pocket costs of an accident. Considering the high volume of traffic near the Winter Park Village or during the daily commute toward Orlando, the risk of a collision is a daily reality.

Without MedPay, a serious injury could leave you with thousands of dollars in medical debt before you even have a chance to file a claim against an at-fault driver. MedPay ensures that your focus remains on healing rather than on how you will pay for your next physical therapy appointment.

Understanding the “Made Whole” Doctrine and Subrogation

A vital part of choosing MedPay is understanding how it affects your final recovery if you decide to pursue a legal claim against an at-fault driver. In Florida, most insurance policies include “subrogation” clauses, meaning that if your insurance company pays for your medical bills and you later receive a settlement from the negligent driver, your insurer may ask to be paid back from that settlement.

But, Florida follows the “made whole” doctrine. This legal principle generally requires that you are fully compensated for all your losses, including pain and suffering, lost wages, and future care, before an insurance company can successfully assert a claim for reimbursement. Navigating these reimbursement claims requires a careful review of your policy language and the specific facts of your accident. Having MedPay ensures you have immediate access to care while we work to ensure your final recovery remains in your hands.
