Clients often ask us how insurance companies make decisions about a case. They want to know how the insurance company decides whether they are willing to pay and if so how much. The truth is we don’t really know. We don’t work for the insurance companies so we don’t have any insider information or tips. There are, however, a few things that we do know. 

For example, several large insurance companies have paid millions of dollars for software programs that help them evaluate a claim. While we can’t be 100% sure how the programs work, over the past 10-15 years we’ve definitely drawn some conclusions. 

This program takes certain information into account such as the location of the accident and the circumstances surrounding the cause of the accident, the injured parties medical bills, medical records, and accident history, and certain keywords, phrases, and diagnostic codes that doctor’s use in medical records. We also know for a fact that insurance companies keep track of settlements with certain attorneys, attorneys they know take cases to trial, and which attorneys they know are willing to litigate cases. Once they have imputed all this information into the program the program gives them a settlement offer based on other case settlements with similar circumstances.
