Clients often ask us if we should negotiate their claim or just go to court and our response depends on the facts and circumstances of the case. In most cases we typically always recommend negotiations.
Negotiations can be beneficial for both parties because they can save the time and money that a trial will cost. Additionally, our client will not only play a role in deciding how much their settlement will be, but they will also know when they are getting it and will get it a lot sooner than if they had gone to trial.
In cases where we can’t come to an agreement with the defense then we must go to trial. Oftentimes plaintiffs and defendants can’t agree on a settlement number, the extent of the plaintiff’s injuries or even who is really at fault. When the two parties can’t agree on these matters then trial is our only option.
