If someone is injured while riding in your car due to someone else’s negligence they could be entitled to your insurance benefits. For example, if someone else causes an accident and your passenger is injured they could file a claim against your personal injury protection (PIP) benefits if they don’t own a car and have a car insurance policy of their own.

Another example in which your passenger may be eligible for your benefits is if someone else causes an accident that injures your passenger and the at-fault party has little to no insurance coverage. This would create an instance where your passenger could use your uninsured or under-insured motorist coverage.

Either scenario doesn’t mean that your passenger will sue you, it just means they are eligible to use your car insurance benefits. This won’t increase your car insurance premium or have a negative impact on your driving record because under Florida law your insurance rates will not change due to an accident that was not your fault.
